Terms of Service

These terms govern your use of https://www.gatewayscientific.com and, where noted, the calibration and repair services provided by Gateway Scientific Inc. ("Gateway Scientific," "we," "us"). By using this site you agree to them.

Services themselves are governed by the quote, purchase order, and any written service agreement between us. Where those documents conflict with this page, those documents control.

Use of this website

You may use this site to learn about our services, request a quote, and contact us. You agree not to:

• Submit false information, or submit forms on behalf of someone without their authority.
• Use automated systems to scrape, harvest, or overload the site or its forms.
• Attempt to gain unauthorized access to any part of the site or its underlying systems.
• Interfere with the site's operation or the use of it by others.

We may suspend access from any source that abuses our forms or systems.

Quotes and pricing

Quotes issued by Gateway Scientific are valid for the period stated on the quote and are based on the instrument list and conditions described to us at the time. If the instruments received differ materially from what was quoted — different counts, channel configurations, volume ranges, or condition — we will tell you and issue a revised quote before proceeding.

Nothing on this website is an offer or a binding price. Pricing pages and plan descriptions are informational.

Scope of service

Service is performed to the plan tier identified on your quote, as described on our service plans page. Calibration is performed in accordance with ISO/IEC 17025 and ISO 8655-1 and 8655-2, and our calibration software is 21 CFR Part 11 compliant.

Preventive maintenance includes cleaning, lubrication, and replacement of seals and O-rings as required. Repairs requiring parts beyond routine maintenance are quoted separately and are not performed without your approval.

Your responsibilities

To let us do the work properly, you agree to:

• Decontaminate instruments before they are handled by our technicians, in accordance with your own procedures, and to provide a decontamination statement where requested.
• Disclose hazards. Tell us if an instrument has contacted anything hazardous. We cannot accept instruments that have contacted select agents, radiological material, or unmitigated biohazards.
• Provide access. For on-site service, provide reasonable bench space, power, and any site access, gowning, or training arrangements agreed in advance.
• Review documentation. Check certificates and reports on receipt and tell us promptly of any discrepancy.

Out-of-tolerance results

Where an instrument is found out of tolerance as-found, we report it to you promptly and provide the as-found data. Assessing the impact of an out-of-tolerance instrument on your prior work is your responsibility, as the party who knows what that instrument was used for. We will support your investigation with data and technical opinion; we do not perform the impact assessment on your behalf unless separately engaged to do so.

Warranty

We warrant that services are performed with reasonable skill and care by qualified technicians, and that calibration results are accurate as of the time and conditions of test.

Instruments are warranted against defects in our workmanship for 90 days from the date of service. If an instrument fails within that period due to our work, we will re-service it at no charge. This warranty does not cover normal wear, misuse, damage, contamination, unauthorized repair, or drift arising from use after service.

Calibration reflects the condition of an instrument at the time of test. It is not a guarantee of continued performance across the interval — that is what intervals and interim checks are for.

Limitation of liability

To the fullest extent permitted by law, Gateway Scientific's total liability arising from any service is limited to the amount paid for the specific service giving rise to the claim.

We are not liable for indirect, incidental, special, or consequential damages, including lost data, lost samples, lost production, or the cost of repeating experimental work. Nothing in these terms excludes liability that cannot lawfully be excluded.

Instruments in our care

Instruments remain in your custody during on-site service. Where an instrument is taken in for repair by agreement, it is inspected and photographed on receipt, risk of loss passes to us while it is in our care, and any damage identified is reported to you the same day with work held until you decide how to proceed.

Payment

Payment terms are stated on your quote or invoice. Unless otherwise agreed in writing, invoices are due net 30 from the invoice date. We may withhold certificates or instruments on materially overdue accounts, after notice.

Intellectual property

The content of this site — text, layout, graphics, photographs, and the Gateway Scientific name and marks — is owned by Gateway Scientific or used with permission. You may not reproduce it commercially without written consent. Calibration certificates and reports issued to you are yours to use, retain, and provide to your auditors and regulators without restriction.

Third-party links

This site may link to third-party websites and standards bodies. We do not control those sites and are not responsible for their content or practices.

Governing law

These terms are governed by the laws of the State of New Jersey, without regard to conflict of law principles. Disputes are subject to the exclusive jurisdiction of the state and federal courts located in New Jersey.

Changes

We may update these terms. The "last updated" date at the top of this page reflects the current version. Continued use of the site after a change means you accept the revised terms. Changes do not retroactively alter the terms of work already quoted or in progress.
